These terms govern the use of the software services provided by Datera ehf.: Kvasir Dashboards, Mímir and Birta, together "the Services". By signing in to a Service you accept these terms on your own behalf and, where you use it for work, on behalf of your organisation. Where your organisation has a written agreement with Datera covering a Service, that agreement takes precedence over these terms if the two conflict.
1. Who may use the Services
The Services are provided to Datera's clients and their staff, and to Datera's own staff. Access is by invitation only. There is no public registration, and you may not share your sign-in with anyone else or allow anyone else to use your account.
Each organisation designates one or more administrators who decide who in that organisation may use a Service, what they can access, and what they may see. Datera acts on those administrators' instructions.
2. Your account
You are responsible for keeping your sign-in credentials confidential and for everything done under your account. Tell us at once at support@datera.is if you believe your account has been used without your permission.
We may suspend an account that we reasonably believe is compromised or is being used in breach of these terms, and we will tell the account holder or their administrator when we do.
3. Acceptable use
You agree not to:
use a Service for anything unlawful, or to infringe anyone's rights
upload or generate content that is defamatory, discriminatory, harassing or otherwise harmful
attempt to gain access to data, accounts or systems you are not authorised to see
probe, scan, overload or interfere with a Service or its infrastructure
use automated means to extract data from a Service other than through features we provide for that purpose
use AI features to generate content that impersonates a real person without their consent, or that is intended to deceive
We may remove content or suspend access to enforce this section.
4. Your content
Content you or your organisation put into a Service, including files, prompts, brand material and media plans, remains yours or your organisation's. You grant Datera and its processors the right to process it as needed to provide the Service. We do not use your content to train AI models and do not allow our providers to do so. How we handle personal data is described in our Privacy and data handling in our services page, which forms part of these terms.
5. AI-generated content
Mímir produces text and images with AI models. Output is generated automatically, may be inaccurate, incomplete or unsuitable, and is provided for you to review and edit; it is not advice. You are responsible for checking anything you publish or rely on. Rights in output you generate belong to you or your organisation, subject to the terms of the underlying model provider.
6. Connected accounts
Kvasir Dashboards displays data from advertising and analytics accounts that your organisation has authorised Datera to read, and other data you may have provided for this purpose. You confirm that you have the authority to grant that access. Datera's use of data from Meta, Google and other platforms is also subject to those platforms' own terms, and you may revoke access at any time in the platform's settings and by reaching out to your contact at Datera.
7. Availability and changes
We aim to keep the Services available continuously but do not guarantee uninterrupted access. We may change, add or remove features, and we may perform maintenance with reasonable notice where it affects availability. Where we intend to discontinue a Service we will give at least 60 days' notice to affected organisations.
8. Fees
Fees for the Services, where they apply, are set out in the agreement between Datera and your organisation. These terms do not themselves create any payment obligation for individual users.
9. Liability
The Services are provided "as is". To the extent permitted by law, Datera is not liable for indirect or consequential loss, loss of profit, loss of data, or business interruption arising from the use of or inability to use a Service, nor for decisions taken on the basis of data displayed or content generated by a Service. Datera's total liability to an organisation in any twelve-month period is limited to the fees that organisation paid for the Service concerned in that period. Nothing in these terms limits liability that cannot be limited by law, including for gross negligence or wilful misconduct.
10. Termination
Your organisation's administrator may remove your access at any time. You may delete your own account at any time as described on service and support pages. Datera may end access for an organisation in accordance with its agreement with that organisation, or immediately for a serious breach of these terms. On termination, content is handled as described in the retention sections of the services page.
11. Governing law
These terms are governed by Icelandic law. Disputes that cannot be resolved by agreement shall be brought before the District Court of Reykjavík (Héraðsdómur Reykjavíkur).
12. Changes to these terms
We may update these terms. The date at the bottom shows the current version. Material changes will be notified to organisations' administrators before they take effect; continued use of a Service after that date constitutes acceptance.
